Longmont Child Support Modification Lawyer
Colorado Spousal Maintenance Modification Attorney
Changes to child support and spousal support are made when a substantial and continuing change occurs in the financial circumstances of one or both of the parties. Modifications to parenting time are usually determined by the courts based on the best interest of the child standard. My law practice focuses exclusively on divorce-related matters. With more than 10 years of experience handling contested and uncontested divorces, I understand Colorado modification guidelines.
At Shea L. Burchill, P.C., I am committed to helping you achieve your goals. I tailor my representation to each client’s unique situation. As an experienced Longmont divorce attorney dealing with child support, spousal support and parenting modifications, I represent individuals pursuing modifications, and I also help individuals challenge modifications. I can evaluate your situation and determine the best course of action.
Basic Modification Guidelines
To obtain a modification to child support, an individual has to experience a substantial and continuing change in circumstances. Notably, application of the child support guidelines to the circumstances of the parties at the time the modification is requested that results in less than a 10 percent change in the amount of support due each month will not be deemed a substantial and continuing change.
Spousal support, or maintenance, can be modified if it’s not contractual maintenance and if a person experiences a substantial and continuing change of circumstances.
Parenting time/custody may be modified if the court finds that a modification would serve the child’s best interest, or if the court finds that the child is physically or emotionally endangered.
It is important that you discuss your situation with a qualified lawyer to determine if you qualify for a modification.
